FREEDOM YOGA SPECIAL EVENT WAIVER, RELEASE & MEDIA CONSENT
By registering for and/or attending any Freedom Yoga class, workshop, programme, or special event in which this waiver is used (the “Activity”), I acknowledge and agree to the terms below. This waiver is intended to be universal and apply to all such Activities, including those conducted in collaboration with partners and where photography/videography may take place.
If I am signing for myself, I confirm that I am at least 18 years of age. If I am signing on behalf of a participant under 18 years old (the “Minor”), I confirm that I am the Minor’s parent or legal guardian and that I have the authority to agree to this waiver on the Minor’s behalf. In that case, references in this waiver to “I” and “my” shall include both me in my personal capacity where relevant and the Minor in relation to the Minor’s participation in the Activity.
Assumption of Risk and Release of Liability
I understand that participation in yoga classes, physical exercises, and related activities conducted by Freedom Yoga & Wellness Pte. Ltd. (“Freedom Yoga”) and its instructors may involve risks of injury, strain, or other physical harm, including both foreseeable and unforeseeable risks. I voluntarily assume all such risks for myself and/or on behalf of the Minor, as applicable, and agree that participation is undertaken voluntarily.
To the fullest extent permitted by law, I agree that Freedom Yoga, its owners, employees, contractors, and agents shall not be liable for any injury, loss, or damage sustained in connection with participation in the Activity, use of facilities, or receipt of instruction, except where such injury or loss arises directly from Freedom Yoga’s gross negligence or wilful misconduct.
Medical Fitness and Responsibility
I warrant that I and/or the Minor, as applicable, are physically fit to engage in yoga and related physical activities and will exercise within appropriate limits. I understand that I should consult a physician where appropriate and that participation should stop immediately if discomfort or pain occurs. Freedom Yoga may refuse or discontinue participation if a condition may pose a risk to the participant or others. If the participant is pregnant, post-natal, or post-surgical, I confirm that the participant has the necessary physician’s approval and that the instructor will be informed where relevant.
Membership and Studio Rules
Membership rights, benefits, and entitlements are not transferable and not exchangeable for any goods or services. Freedom Yoga may amend rules from time to time and may terminate membership for non-compliance. No gambling, betting, fighting, or physical/verbal abuse is permitted on the premises. Only Freedom Yoga employees are authorised to offer yoga training or related services within the studio. Freedom Yoga is not responsible for lost, damaged, or stolen property and will not conduct searches of persons or belongings. Facilities or services may be unavailable due to mechanical breakdown, maintenance, fire, or circumstances beyond Freedom Yoga’s control. Management may suspend or terminate the rights or privileges of any person whose actions are detrimental to the studio, its image, members, staff, or shareholders. Entry is permitted only during official operating hours. Smoking is strictly prohibited.
Media Capture & Usage (Freedom Yoga & Partners)
I understand that photography, videography, and/or audio recording (collectively, “Media”) may occur during the Activity. Such Media may be captured by Freedom Yoga, by its collaborating partner(s) identified in the Activity/class description on Freedom Yoga’s website or marketing materials, or by professional photographers/videographers engaged by either party.
By registering for and/or attending the Activity, I grant Freedom Yoga and its collaborating partner(s), including their respective owners, employees, contractors, agents, affiliates, designees, and service providers, a perpetual, worldwide, royalty-free, transferable, and sublicensable licence to capture, use, reproduce, edit, adapt, publish, display, distribute, and otherwise exploit Media that includes me and/or the Minor’s image, likeness, and/or voice, in any format and on any channel now known or later developed, including but not limited to websites, social media, advertising, editorial, and internal communications, without further notice or approval. This consent is given for the purpose of promoting or documenting the Activity and the ongoing initiatives of Freedom Yoga and the collaborating partner(s).
I waive any right to inspect or approve the finished materials and any claim for compensation, royalties, or damages arising from such use, whether by Freedom Yoga or its collaborating partner(s).
Reasonable Accommodations (Media)
If I prefer that I and/or the Minor not appear in close-up Media, I will inform Freedom Yoga staff or the on-site photographer before the Activity begins. Freedom Yoga and its collaborating partner(s) will use reasonable efforts to accommodate such requests, for example through mat placement; however, complete exclusion from wide-angle or group imagery cannot be guaranteed.
Personal Data and Marketing Communications
I grant Freedom Yoga and its officers, employees, and agents the right to collect, use, and disclose my personal data, and where applicable the Minor’s personal data provided by me, for the following purposes:
- to manage registration, participation, membership, and provide relevant services;
- to respond to queries and feedback;
- to facilitate class bookings and studio access;
- to send updates, offers, and marketing communications about current and future promotions, events, and products via phone, text, email, direct mail, or in-app notifications; and
- to improve customer experience and studio operations.
All new accounts will automatically be included in Freedom Yoga’s marketing communications unless the recipient chooses to opt out through account settings or by contacting Freedom Yoga directly. Freedom Yoga’s collection, use, and disclosure of personal data are conducted in accordance with the Personal Data Protection Act 2012 (PDPA) and its associated regulations.
Release and Indemnity
For myself and, where applicable, on behalf of the Minor, and for our respective heirs, executors, administrators, and assigns, I hereby release, waive, and forever discharge Freedom Yoga and its collaborating partner(s) from all claims, demands, damages, costs, actions, or causes of action, whether in law or equity, arising from or in connection with (a) participation in the Activity and/or use of the facilities, and (b) the creation, processing, or use of Media in which I and/or the Minor may appear, except where prohibited by law or where such injury or loss arises directly from gross negligence or wilful misconduct. I agree to indemnify and hold harmless Freedom Yoga and its collaborating partner(s) from claims by third parties attributable to my acts or omissions, and where applicable the Minor’s acts or omissions, in connection with the Activity, to the extent permitted by law.
Acknowledgment and Agreement
By agreeing to this waiver, I acknowledge that I have read, understood, and voluntarily accepted the terms and conditions stated above. I understand it is intended to cover all Activities where this waiver is used, including special events with collaboration partners and photo/video capture. If I do not agree, I will not register for or attend the Activity, and if I am signing on behalf of a Minor, I will not permit the Minor to attend the Activity.
